TERMS &
CONDITIONS

These terms govern the relationship between Oceanique ("we," "the operator") and any person ("the guest," "you") who enquires about or books a charter service. By making a booking or submitting an enquiry, you agree to these terms. Please read them carefully before proceeding.
1. OPERATOR DETAILS
Oceanique operates yacht charter services from 56/11 Bali Hai Pier, Walking Street, South Pattaya, Chon Buri 20150, Thailand. You can reach us by phone at +66 38 537 284 or by email at [email protected].
2. CHARTER SERVICES
We offer the following charter types, each subject to availability and sea conditions:
- Harbor Evening Tour — approximately 2.5–3 hours, inner harbor, Pattaya waterfront, drinks and light dishes included (฿6,500)
- Outer Islands Day Charter — 7–8 hours, Koh Phai / Koh Klung Badan / Koh Rin, Thai seafood lunch, snorkel gear provided (฿19,000)
- Eastern Seaboard Multi-Day Cruise — 2–4 days, Pattaya to Sattahip and Rayong coastline, all meals and provisions included (฿24,500 per day)
Service descriptions on our website are provided for general guidance. Specific itinerary details, including route, swim stops, and meal content, may vary depending on conditions on the day of departure.
3. BOOKING & CONFIRMATION
ENQUIRY & AVAILABILITY
All bookings begin with an enquiry. Availability is not confirmed until you receive written confirmation from Oceanique. Submitting an enquiry form or making an initial payment does not constitute a binding reservation until we have issued a confirmation.
DEPOSIT
A deposit may be required to secure a booking date. The deposit amount and payment method will be confirmed in writing at the time of reservation. Deposits are non-refundable except in the circumstances described in Section 5.
BALANCE PAYMENT
The remaining balance is typically due on or before the departure date, unless otherwise agreed. Payment terms will be stated in your booking confirmation.
4. PRICING
Prices displayed on our website are quoted in Thai Baht (฿) and include the items specified in the service description. Unless stated otherwise, prices do not include:
- Alcoholic beverages beyond the standard charter provision
- Special requests for premium food or drink items
- Transfers to and from the pier
- Gratuities for crew (optional and at the guest's discretion)
- Any personal expenses or purchases made during the trip
We reserve the right to adjust prices for future bookings. Any price change will not affect confirmed reservations where a deposit has already been received.
5. CANCELLATION POLICY
CANCELLATION BY THE GUEST
If you wish to cancel a confirmed booking, please notify us in writing as soon as possible. The following terms apply:
- Cancellations made 14 days or more before departure — deposit forfeited, no further charge
- Cancellations made 7–13 days before departure — 50% of the total charter fee is payable
- Cancellations made less than 7 days before departure — the full charter fee is payable
We understand that circumstances change, and we will always try to find a rescheduling option where possible.
CANCELLATION BY OCEANIQUE
We reserve the right to cancel or postpone a charter if sea conditions are assessed as unsafe for departure. In these cases, we will contact you as early as possible and offer either a full refund or a rescheduled departure. We are not liable for any travel or accommodation costs incurred as a result of weather-related cancellations.
WEATHER & FORCE MAJEURE
Charters operate subject to weather and sea state assessments made by the captain on the day. If a charter is shortened or modified due to weather after departure, a partial refund may be considered at our discretion. We are not responsible for conditions beyond our reasonable control, including severe weather, natural events, or government-issued maritime restrictions.
6. GUEST RESPONSIBILITIES
CONDUCT ON BOARD
All guests are expected to behave in a manner that is respectful to the crew, to other guests, and to the vessel. The captain has full authority over the operation of the yacht and the safety of everyone on board. Any instruction given by the captain or crew for safety reasons must be followed immediately.
ALCOHOL & SUBSTANCES
Moderate alcohol consumption during a charter is permitted. The captain may refuse boarding or request a guest to disembark at any port if their conduct is impaired or disruptive. Illegal substances are not permitted on board under any circumstances.
HEALTH & MEDICAL CONDITIONS
Guests with medical conditions that may be affected by sea travel, extended sun exposure, or physical activity are encouraged to consult a medical professional before booking. Please notify us of any medical conditions or mobility considerations at the time of booking so we can plan accordingly.
CHILDREN
Children are welcome on all charters when accompanied by a responsible adult. The accompanying adult is responsible for the safety and supervision of any child in their care throughout the trip. Life jackets suitable for children are available on board.
PERSONAL PROPERTY
Guests are responsible for their own personal belongings. Oceanique accepts no liability for loss, damage, or theft of personal items brought on board.
7. SAFETY & INSURANCE
Our vessels are maintained in compliance with applicable Thai maritime regulations and carry the required safety equipment, including life jackets, flares, fire extinguishers, and first aid supplies. The captain holds the necessary certifications to operate in Thai coastal waters.
We hold third-party liability insurance covering the operation of our charter vessels. This insurance does not cover the personal belongings or travel arrangements of guests. We recommend that guests arrange their own travel insurance, including medical coverage, before departure.
For multi-day cruises, comprehensive travel insurance that includes emergency medical evacuation is strongly advised.
8. LIABILITY
Oceanique takes the safety of our guests seriously and operates with care and professionalism. However, sea-based activities carry inherent risks. By boarding our vessel, guests acknowledge these risks and agree that Oceanique, its crew, and its representatives are not liable for:
- Personal injury or illness arising from activities voluntarily undertaken during the charter
- Loss or damage to personal property
- Any consequential losses arising from weather-related changes to the charter
- Events beyond our reasonable control
Nothing in these terms excludes liability for death or personal injury caused directly by our negligence.
9. PHOTOGRAPHS & MEDIA
Our crew may occasionally photograph or film charter experiences for use on our website or social media. If you would prefer not to appear in any such content, please let us know before departure and we will respect your preference. Guests are welcome to take their own photographs during the trip.
10. ENVIRONMENTAL RESPONSIBILITY
We ask all guests to help us care for the marine environment during their time on board. Specifically:
- No plastic waste or rubbish should be disposed of overboard
- Reef-safe sun cream is encouraged when snorkelling or swimming near coral areas
- Marine life should be observed but not touched or collected
- Please follow crew guidance on anchor placement and swim areas to avoid reef damage
11. GOVERNING LAW
These terms are governed by the laws of the Kingdom of Thailand. Any dispute arising from a charter booking or service will be subject to the jurisdiction of the courts of Chon Buri Province, Thailand.
12. AMENDMENTS
We may update these terms from time to time. The version in effect at the time of your booking confirmation applies to your reservation. Material changes to these terms will be reflected in a revised "Last Updated" date at the top of this page.
